The Case
A Family's Case and a Public Record
The litigation arises from the Farwell family's residence at the Fountains at Tidwell apartment community in Houston, Texas. Farwell alleges that the family experienced serious problems with conditions at the property, including moisture, water intrusion, mold, and related maintenance issues, and that those conditions resulted in significant harm.
The dispute eventually moved from the apartment complex into the courts. The litigation has involved questions concerning the underlying housing claims as well as procedural rulings, appellate jurisdiction, preservation of the record, and whether the claims received full consideration on their merits.
